About Instructiv and our Privacy Policy

This Privacy Policy applies to our website, which Instructiv owns and operates (our “Site”). This Privacy Policy does not relate to Student Records. This Privacy Policy describes how Instructiv collects and uses the information you provide to us through and in connection with the Site and describes the choices available to you regarding our use of your personal information and how you can access and update this information.

We use the data we collect to provide you with a better experience and fulfill our mission of providing educational support services as a Minnesota general benefit corporation whose purpose is to improve retention and work satisfaction of educators in the special education field, and through innovation, technology, and scientific methods, improve outcomes for all children enrolled in special education programs.

Our Privacy Policy describes what information we gather from people who use or visit our Site, how we use that information, and what we do to protect it. By visiting or using our Site, you consent to the information handling practices described in this Privacy Policy.

Your use of our Site and any information you provide to us are subject to the terms of this Privacy Policy, which is incorporated into and subject to our Terms of Service. Any capitalized terms used but not defined within this Privacy Policy have the meaning given to them in our Terms of Service.

1. What information do we collect?

You can access certain information on our Site without registering for an account or providing any other personal information. Information collected by this site absent you registering for an account or communicating with us includes information as described more fully below that allows us to provide you a better experience.

If you communicate with us, you may provide Instructiv personal information such as your name, email address, or other information that can be used to identify you (“Personal Information”).  Information that cannot be used to identify you as an individual is non-personal information.

We collect information through the Site, including Personal Information, in a variety of ways, which may vary according to your use of the Site. The categories of information we collect may include information you provide to us and information we receive about you from others, such as:

  • Applicant data

  • Non-personal information that may be linked to your Personal Information

We may collect access and usage information about your use of our Site. This enables us to tailor our Site to your needs.

Location information.

We may collect and use information about your location or your approximate location based on your IP address, but we don't collect the precise geolocation of you or your device. Although we do our best to honor the privacy preferences of our users, we are unable to respond to Do Not Track signals set by your browser at this time.

We use or may use the data collected through tracking technologies to better display our website, to save you time, to provide better technical support, and to track website usage. For example, cookies help us to:

  • Remember your settings on the pages you visit, so that we can display your preferred content the next time you visit.

  • Track website usage for various purposes including sales, marketing, and billing.

Other information

If you apply for a job or other position with Instructiv via an online recruiting site, we will obtain the information you provide in your application for that purpose.

2. How we use the information we collect

Instructiv uses information, other than applicant information, to:

  • Operate, maintain, enhance, and provide all of the features of our site.

  • Personalize your experience.

  • Communicate with you.

  • Maintain, improve, and develop our site.

3. How we share or transfer data

Instructiv takes great care to protect the information you provide us. We do not rent or sell your Personal Information to third parties.

Instructiv will not disclose your Personal Information unless you consent or instruct us to share it or when we have a legitimate business or legal need to share your information. If you do provide consent to share your Personal Information with authorized partners, not-for-profit organizations, and other entities that are not affiliated with Instructiv, we will only provide to these third parties the information you have authorized or asked us to share.  We may also disclose anonymous or aggregate information that does not reasonably identify you as an individual. We may share anonymous or aggregate data with others.

We may use data which has been de-identified and/or aggregated for product development, research, analytics and other purposes, including for the purpose of analyzing, improving, or marketing our services.  Instructiv may share this data with business partners to improve our services or offerings. If we disclose information to authorized business partners to conduct research on or assist in understanding the usage, viewing, and demographic patterns for certain business purposes, that data will be aggregated and/or anonymized to reasonably avoid identification of a specific individual.

Other instances where we may share or disclose information for legal or business purposes.

We will share data with employees and service providers. Instructiv may share information with our employees and trusted vendors, third party service providers and other individuals to provide services or products for us or on our behalf, which could include analytics, hosting, marketing and similar services. When we share personal information with third party service providers or vendors, these third parties are contractually obligated to maintain the security and confidentiality of that personal information.

We may share data in the context of a change of business, including a merger or acquisition. In the event that Instructiv is involved in a merger, acquisition, bankruptcy, change of control, or any form of sale of some or all of our assets, your Personal Information may be transferred or disclosed in connection with such business transaction.

Instructiv may release Personal Information if we have a good faith belief that access, use, preservation, or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process, or enforceable governmental request; (b) enforce applicable Terms of Service, including investigation of potential violations thereof; (c) investigate and defend ourselves against any third-party claims or allegations; (d) detect, prevent or otherwise address fraud, security or technical issues; (e) protect the rights, property, or personal safety of Instructiv, our users, or the public; or (f) as required or permitted by law.

4. Marketing and Sponsored Content

We may, from time to time, send you email regarding our products and services, or other third-party products and services we think you may find benefit from if you have provided us with an email address. We will not share your information with the third party unless you provide opt-in consent for us to do so. You can unsubscribe from these mailings at any time by using the unsubscribe features included in those emails.

5. Your choice and options relating to data collection and use

At Instructiv, we use Personal Information as needed for the purposes for which it was collected or where you have consented to our use of your Personal Information. We take reasonable steps to ensure that the Personal Information we store and use is accurate, complete, and up-to-date. If you discover that Personal Information or other data pertaining to you is inaccurate, incomplete, or out-of-date, please update your account information or contact us as outlined below.

6. How to access, update, or delete your personal information

We want you to have access to your information, so that you can help keep it as accurate as possible. If you provide Instructiv with Personal Information, you may update, correct, or delete your information at any time by sending an email to: hello@instructiv.app. Unless we receive a deletion request, we will retain your information for as long as reasonably useful for operational purposes. For example, we may retain certain data as necessary to prevent fraud or future abuse, for record-keeping or other legitimate business purposes, or if required by law. We may also retain information which has been de-identified or aggregated such that it can no longer reasonably identify a particular individual. All retained Personal Information will remain subject to the terms of this Privacy Policy.

7. Data Security

We try to ensure that our Site and information sent to us are safe, but no security measures are perfect. Instructiv uses certain physical, administrative, and technical safeguards designed to preserve the integrity and security of your Personal Information and other information we maintain.  Instructiv makes commercially reasonable efforts to ensure the security of our systems.  In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate and will notify you of the security incident in accordance with applicable laws and regulations.

8. How does Instructiv protect Children's privacy?

Instructiv does not use this Site to target or collect information from children under the age of 13 (a “Child” or “Children”). If you believe we have inadvertently collected information from a child under 13 without parental consent, please contact us so that we may delete the information as soon as possible.

9. International Visitors

Our Site, and all of our services, are operated and managed on servers located within the United States, and the services we provide to Schools, students, and families are offered only to US residents. If you choose to access our Site from the European Union or other regions of the world with laws governing data collection and use that differ from United States law, then you acknowledge that Instructiv will transfer your Personal Information to the United States for the purpose of performing the Services according to our contract (e.g., our Terms of Service) and for any other purpose for which you provide explicit, informed consent.

10. Links to other sites

The Site may link to and may be linked by websites operated by other entities or individuals. This Privacy Policy does not apply to, and we cannot always control the activities of, such other third-party websites. You should consult the respective privacy policies of those third-party websites.

11. Changes and updates to this Privacy Policy

Instructiv may modify or revise this Privacy Policy from time to time. Instructiv will notify users of any changes to our Privacy Policy by posting the revised Privacy Policy with a revision date on our website. If we change this Policy in a material manner, we will do our best to notify you of the changes by posting a notice on our website. Your continued use of the Site following the effective date of such update constitutes your acceptance of the revised Policy.
